Attorneys Craig Nolan and Kevin Lumpkin recently secured a victory in the Vermont Supreme Court in SynEcology Partners L3C v. Business RunTime, et al., successfully arguing that the Court should affirm the trial court’s decision to dismiss the case for discovery violations.
In the trial court, SynEcology Partners failed to comply with the trial court’s discovery orders. Sheehey successfully moved the court for dismissal and also obtained a judgment for attorneys’ fees. In an opinion issued on March 4, 2016, the Vermont Supreme Court unanimously upheld the trial court’s ruling, holding that it acted within its authority to dismiss the case.
